UU NO. 21 TAHUN 2000  Serikat buruh yang baru tidak boleh dicatatkan dengan logo yang sama dengan serikat buruh terdaftar

Yth,  Mr Presiden,

Konfederasi Serikat Buruh Internasional (ITUC), yang mewakili lebih dari 176 juta buruh di 162 negara dan wilayah, termasuk Indonesia, mengutuk keras campur tangan pemerintah Anda dalam fungsi internal KSBSI.

ITUC mendukung KSBSI dengan memprotes tegas terhadap sikap Bapak Muchtar Pakpahan yang mengundurkan diri dari organisasi ini pada bulan September 2012, tetapi, sejak saat itu, telah terus mengklaim dukungan dari pemerintah setelah mendirikan serikat saingan menggunakan nama yang sama.

ITUC ingat bahwa pada tahun 2011 KSBSI menggelar Kongres yang dihadiri oleh perwakilan serikat di seluruh Indonesia dan dipilih secara demokratis, Muchtar Pakpahan terpilih sebagai salah satu Dewan Penasehat tetapi memutuskan untuk mengundurkan diri dari KSBSI satu tahun kemudian. Pada bulan Desember 2012, ia menciptakan serikat baru dan menggunakan nama yang sama dan logo KSBSI. Organisasinya terdaftar di Departemen Tenaga Kerja Jakarta Pusat pada awal 2013 melawan UU N ° 21/2000 yang menyatakan bahwa "serikat buruh lain tidak boleh menggunakan nama yang sama dan logo serikat pekerja yang sudah terdaftar".

KSBSI telah memprotes keputusan ini, pemerintah tetap diam dan terus mendukung Pak Muchtar Pakpahan, yang kini menggugat kembali KSBSI di Pengadilan Niaga Jakarta Pusat pada penggunaan logo meminta pembayaran denda sebesar Rp. 6,8 miliar, serta mengajukan pidana terhadap   Presiden, Sekretaris Jenderal dan Dewan Penasehat organisasi KSBSI.

ITUC prihatin tentang serangan terus dari Bapak Muchtar Pakpahan didukung oleh pemerintah Anda, yang dapat mempengaruhi proses dari KSBSI kongres yang akan datang dijadwalkan untuk 4 -7 Mei 2015.

Oleh karena itu ITUC, mendesak pemerintah untuk mencegah Mr. Pakpahan menyalahgunakan nama serikat di mana ia tidak memiliki posisi terpilih, dan untuk menghormati ketentuan-ketentuan Konvensi ILO 87 tentang Kebebasan Berserikat, diratifikasi oleh negara Anda, yang menyatakan dalam pasal 3 bahwa serikat buruh berhak "untuk mengatur administrasi dan kegiatan mereka dan untuk merumuskan program-program mereka" dan bahwa "berwenang/pemerintah  harus mencegah adanya campur tangan yang akan membatasi hak ini." 2

ITUC tetap berharap bahwa pemerintah akan bertindak secara bertanggung jawab, tetapi juga siap untuk mengajukan keluhan terhadap Pemerintah Indonesia di ILO dan Lembaga Internasional lainnya dalam kasus permintaannya tidak puas.

Attack against KSBSI 

Dear Mr. President, 

The International Trade Union Confederation (ITUC), that represents over 176 million workers in 162 countries and territories, including Indonesia, strongly condemns the interference by your government in the internal functioning of KSBSI. 

The ITUC supports KSBSI by protesting firmly against the attitude of Mr. Muchtar Pakpahan who resigned from this organisation in September 2012 but, since then, have continued to claim the support of your government after establishing a rival union using the same name. 

The ITUC recalls that in 2011 KSBSI hold its Congress attended by union representatives throughout Indonesia and elected democratically its officers. Muchtar Pakpahan was elected as one of the Advisory Board but decided to resign from KSBSI one year later. In December 2012, he created a new union and used the same name and logo of KSBSI. His organisation was registered in the Ministry of Manpower of Central Jakarta in early 2013 against the Law N°21/2000 which states that “Another trade union may not use the same name and logo of a registered trade union”. 

Despite the fact that KSBSI protested against this decision, the government remained silent and continued to support Mr. Muchtar Pakpahan, who is now suing back KSBSI in the Central Jakarta Commercial Court on the use of the logo requesting the payment of a fine of Rp. 6.8 billion, as well asking charges against the President, the General Secretary and the Advisory Council of the organisation. 

As such, the current KSBSI leadership as well as the ITUC are concerned about the continuing attacks from Mr. Muchtar Pakpahan supported by your government, that may affect the proceedings of the forthcoming KSBSI congress scheduled for 4 -7 May 2015. 

The ITUC therefore, urges your government to prevent Mr. Papuan from misusing the name of a union in which he has no elected position, and to respect the provisions of the ILO Convention 87 on Freedom of Association, ratified by your country, which states in its article 3 that trade unions shall have the right “to organise their administration and activities and to formulate their programmes” and that “public authorities shall refrain from any interference which would restrict this right.” 2

The ITUC remains hopeful that your government will act responsibly but is also prepared to lodge a complaint against the Government of Indonesia at the ILO and other International Institutions in case its request is not satisfied.
