Vonis 2 Tahun Penjara untuk 2 Pejuang Buruh

DEN KSBSI akan menyerahkan Award Pejuang buruh untuk 2 anggota FKUI di PT DAP. Mereka berjuang untuk perbaikan upah dan kontrak kerja precarious. Kita akan menghimpun dana solidaritas. Tidak ada kekerasan dalam aksi mereka. Mereka demo dengan damai dan dituduh pasal karet perbuatan tidak menyenangkan dan penghasutan 160 KUHP yg sudah dipeti es kan. 

Menyusul ditahannya dua pimpinan PK FKUI SBSI PT DAP, pengusaha melakukan pemberangusan Seikat buruh dengan memecat semua anggota FKUI sekitar 50 orang lebih. Perusahaan ini anti serikat buruh.

Dgn preseden ini semua pemimpin buruh di Indonesia bisa dipidana dan FKUI bisa dibubarkan dgn UU ORMAS. SALAM REFORMASI..... SALAM DEMOKRASI..... DAP adalah supply chain ke GAR , JUGA DIDUGA TERKAIT WILMAR DAN NESTE FINLAND. Karena CPO yg diproduk akan tercampur dan dikirim ke RAKSASA SAWIT YG MENDUNIA. Kemudian menjadi banyak produk turunan makanan dan konsumsi merk2 ternama global termasuk bahan bakar terbarukan. Selamat menikmati minyak sawit dari ketidakadilan perlakuan ke buruh. DEN KSBSI will submit the Workers Fighters Award for 2 FKUI members at PT DAP. They are fighting for wage improvements and precarious contracts of work. We will raise funds of solidarity. There was no violence in their action. They had a peaceful demo and were accused of the unfavorable piece of rubber and the sedition of 160 Criminal Code which had been frozen.

Following the arrest of two leaders of PK FKUI SBSI PT DAP,  Enterprise  conducted the union busting  by dismissing all FKUI members about 50 more people. This company is anti trade union.

With this precedent all workers leaders in Indonesia can be convicted as provokator to increase workers living condition and FKUI can be BAN as using  the ORMAS Act.  REFORM ..... ..... DEMOCRACY ..... DAP is the supply chain to GAR, ALSO RELATED TO WILMAR AND NESTE FINLAND. Because the CPO in the product will be mixed and sent to GLOBAL PALM  OIL  PRODUCT. DIALOG SOSIAL DAN KEP. OBVITNAS

Beberapa ahli sosial mendefinisikan dialog sosial  sbb:  A Productive Dialogue explores the understanding of political processes, systems, and behavior that animates both thinkers. Kira-kira artinya: " Produktif dialog mengeksplor pengertian dari proses politik, system, dan prilaku dari kedua pihak yang terlibat". 

Sosial dialog memahami pengertian dari kedua belah pihak, memahami juga keberadaan dari kedua belah pihak. 

Apa kaitannya dengan OBVITNAS? Obvitnas adalah kebijakan Fasis sebagai pendekatan keamanan gaya ORDE BARU yang dikemas dengan gaya baru. Bahkan pada Periiode Orde Baru Suharto mencabut OBVITNAS pada perusahaan-perusahaan BUMN. Kebijakan OBVITNAS untuk Swasta adalah pertunjukan yang fulgar dari ideologi Neo Liberal. 

Sejak 2014 kebijakan Obvitnas malah diterapkan ke Swasta dan Kawasan EPZ (Ekspor Processing Zone), Kuat dugaan produk kebijakan Obvitnas ini justru pesanaan untuk mengamankan kawasan EPZ dan kawasan Industri yang belum berstatus Berikat dan EPZ dalam rangka pendekatan keamanan.

Menteri Perindustrian (Menperin) MS Hidayat menyerahkan sertifikat Objek Vital Nasional Sektor Industri (OVNI) kepada 49 perusahaan industri dan 14 kawasan industri.

Dengan penyerahan sertifikat tersebut, seluruh perusahaan dan kawasan industri tersebut berhak mendapat perlindungan sesuai Surat Keputusan Menteri Perindustrian Nomor 466 tahun 2014. Keputusan ini merupakan amanat KEPUTUSAN PRESIDEN REPUBLIK INDONESIA. NOMOR 63 TAHUN 2004. 

Kedua Keputusan ini melarang buruh untuk mogok di Kawasan Objek Vital Nasional. Selain itu Kawasan Obvitnas adalah kawasan yang istimewa dengan perlindungan menyeluruh dari soal ekonomi dan keamanan tanpa batas. Muspida termasuk Militer (Kodim, Babinsa, Koramil, dan seluruh aparat daerah dan Polisi memiliki otoritas langsung) bila kawasan Objek Vital Nasional merasa diganggu oleh kelompok buruh secara ekonomi, keamanan, maupun politik. Peraturan ini sangat karet dan sangat jelas mengatur pelarangan mogok untuk kawasan ini. 

Tindakan mogok kerja bagi buruh di kawasan Obvitnas adalah sebuah bencana, karena akan berhadapan dengan tindakan aparat yang tak terduga. 

Pertauran ini tentunya sangat bertentangan dengan Konvensi ILO 87 dan 98, juga UUD 45, tentang kebebasan berserikat dan  berekspresi. Juga UU 21 tahun 2000. Tapi belum satupun organisasi yang menguji Peraturan ini. 

Dialog sosial hanya bisa berlaku bila kedua pihak baik buruh maupun pengusaha memiliki posisi yang seimbang dan memahami kekuatan keduanya. Pengkebirian hak buruh juga semestinya diimbangi dengan pengkebirian hak pengusaha yaitu larangan menutup perusahaan dan larangan melakukan PHK. Bila melakukan penutupan perusahaan dan mem PHK yang mengganggu stabilitas nasional seharusnya juga dikriminalkan dan dipanggil Muspida yang temasuk tentara di dalamnya.

Ketidakadilan kebijakan yang pro Kapitalis ini sesunggunya penghianatan terhadap aspirasi buruh dan ciri ini adalah ciri negara Fasis ORDE BARU. 

Tidak ada gunanya Peraturan tentang Upah Minimum dan peraturan normatif lain, karena para pemodal tidak akan pernah khawatir dengan pelanggaran, karena hak mogok buruh sudah dikebiri.

Social dialogue understands the understanding of both parties, understanding also the existence of both parties.

What does it have to do with OBVITNAS? Obvitnas is a Fascist policy as a new ORDE style security approach packaged in a new style. Even in the New Order Period Suharto repealed OBVITNAS on state-owned companies. OBVITNAS's Private Policy is a fulgar show of Neo Liberal ideology.

Since 2014, the policy of Obvitnas has even been applied to Private and EPZ (Export Processing Zone) Areas. The strong allegation of Obvitnas policy product is precisely the message to secure the EPZ and Bonded Industrial zones and EPZ in the framework of the security approach.

                                SOCIAL DIALOG AND NATIONAL VITAL OBJECT

Minister of Industry MS Hidayat has awarded the National Vital Industry Sector (OVNI) certificate to 49 industrial companies and 14 industrial estates.

With the certificate submission, all companies and industrial estates are entitled to protection in accordance with Decree of the Minister of Industry Number 466 of 2014. This Decree is a mandate of DECISION OF THE PRESIDENT OF THE REPUBLIC OF INDONESIA. NUMBER 63 YEAR 2004.

Both of these decisions prohibit workers to strike in the National Vital Objects Area. In addition, the Obvitnas Region is a privileged area with comprehensive protection from economic and security issues indefinitely. The Muspida includes the Military (Kodim, Babinsa, Koramil, and all local authorities and the Police have direct authority) if the National Vital Object area feels harassed by the economic, security, and political workers. This regulation is very rubbery and very clearly governs the prohibition of strikes for the region.

The strike action for workers in the Obvitnas region is a disaster, as it will deal with unexpected actions of the authorities.

This struggle is certainly very much against the ILO Conventions 87 and 98, as well as the 1945 Constitution, on freedom of association and expression. Also Law 21 of 2000. But no organization has tested this Regulation.

Social dialogue can only apply if both parties both workers and employers have a balanced position and understand the strength of both. The eradication of labor rights should also be offset by the cultivation of entrepreneurs' rights, namely the prohibition on closing the company and the prohibition of layoffs. When closing down companies and laid off disruptions to national stability should also be criminalized and summoned by the Muspida, which includes troops in it.

This pro-capitalist policy injustice is in fact a betrayal of workers' aspirations and this characteristic is the hallmark of the new ORDER Fascist state.

There is no point in the Regulation on Minimum Wage and other normative rules, because investors will never be worried about violations, because the right to strike is castrated.
